ARGENTINA JUSTICE RESOLVED
That The Turkish State Committed Genocide
Against
The Armenian People

  Federal Judge Norberto Oyarbide resolved with final sentencing authority that the Turkish state, has committed the crime of genocide at the expense of the Armenian people, in the period between 1915 and 1923. In the same ruling states that "as part of processing this case No. 2.616/2002, and the historical context of the facts established on the basis of the statements contained in operative paragraph I, which have been found with the same body of evidence, the pre-existence and character of victims of paternal and maternal families of Gregory Hairabediбn, members of the Armenian People residing in the Ottoman Empire, then State of Turkey. 

In just 24 days of 96 th anniversary of the genocide of Armenians, Armenia Argentina Community closes ten years of search for truth in court Argentina with a ruling that recognizes the genocide of Armenians in a context which, as stated by the same fault: is the result of a new segment opened proceedings in Argentina, with illuminating processing entity of events that undoubtedly gain insertion into the so-called crimes against humanity, and in that context, the precise type of genocide, whose evocation and memory require consideration in a legal status according to the severity of the crime committed. "

The judge"s ruling Oyarbide is the conclusion of a lengthy judicial process initiated on 29 December 2000 by the scribe Gregory Hairabedian when sued for the Truth and the Right to Duel on the Genocide of Armenians by the Turkish State during the years 1915 - 1923, which specifically were victims family members paternal and maternal filed at that time in the Zeitoun vilayets of Palu and in Armenia at that time under the dominion of the Ottoman Empire.

These proceedings shall be conducted before the National Federal Criminal and Correctional No. 5, by Dr. Norberto M. Oyarbide, Secretariat No. 10, by the Diani Dr.Pedro of the Autonomous City of Buenos Aires. After appealing a decision against the first instance, the Hon. National Clearinghouse for Criminal and Correctional ordered the Court of First Instance to conduct an investigation as part of what has been called "Trials Search for Truth."

In 2002, Dr. Oyarbide Court asked the Turkish government, through the Argentina Chancellery, detailed reports on the fate of paternal and maternal relatives of Gregory Hairabediбn, between 1915 and 1923 and to make available files possession relating to such events. It also requested information from the governments of Great Britain, USA, Germany and the Vatican State. In 2005, extended the requested information from Egypt, Jordan, the Palestinian Authority, Iran, Syria, Lebanon, the International Committee of Red Cross and the Armenian Church.

It is important to note that in December 2005, the Community institutions Armenia joined as co complainants to the expansion of demand for the Right to the Truth on Armenian Genocide. These institutions are:The Administrative Institution of the Church Armenia, Cutural Association Armenia, Armenia Argentine Chamber of Industry and Commerce, Cultural Union Armenia, Armenia Compatriot Union of Marash, Tekeyan Association and Union of Armenians of Hadjin Residents, Armenia General Union for Physical Culture and Civil Association Armenia"s Charities of South America.

For ten years, conducted a thorough search of official documents of the states of France, Belgium, Germany, Vatican and Britain to obtain documents that could be presented at trial by way of supporting evidence. Part of that process included the collection of oral testimonies from survivors of the Armenian genocide living in Argentina, work that was done with the methodology and team collaboration Oral History Program at the University of Buenos Aires. They have also submitted reports on the Armenian genocide the Armenian Apostolic Church, the Catholic Church and the Evangelical Church Armenia Armenia.

In April 2010, at the 95th anniversary of the Armenian genocide, the presentation of evidence collected, translated and certified before the court decided in December of that year filed a "Request" signed by the authorities of the Armenian community in Argentina with Gregory Hairabedian, asking the sentencing judge based on the evidence presented throughout the process. At least 10 survivors and children of Armenian genocide survivors living in Argentina provided testimony before Judge Oyarbide. Also presented testimony from New York Times Press, Washington Post, Manchester Guardian, Boston Daily, La Naciуn, La Prensa and La Razon of the periods 1915-1923. Also added a detailed report with the international recognition of Armenian genocide, and particularly the position of the Argentine State, expressed in the enactment of Law 26,199 and a certificate from the Archbishop of the Armenian Church where it is stated that they do not have records of the whereabouts of Hairabedian Gregorio relatives.

With this ruling, the Collective Argentina Armenia in not only a valuable landmark decision reached in the context of the trial process for Truth, but also initiates a new stage which is the repair to the Armenian victims of genocide.
